2.4 Million Dollar Settlement – Wrongful Death/Truck v. Auto/Personal Injury

Facts: Diane Wright was stopped for slowing traffic while driving eastbound on Interstate 80 in Vacaville when her vehicle was hit by a truck. The truck was driven by defendant Edward Robison, who was in the course of his employment with defendant Sheedy Drayage Inc. Wright’s adult children (ages 23 and 30) filed suit against Robison and Sheedy Drayage, alleging motor vehicle negligence and vicarious liability.
Plaintiffs’ Contentions: Wright’s children contended that Robison was driving at a dangerous speed and was inattentive, causing the accident.
Defendants’: Robison alleged that two other drivers, Stephanie Englebrecht and Robert Jones, were also responsible for the accident, after stopping ahead of Wright and coming into contact with each other.
Injuries: Wright was cut from her vehicle, which was crushed, and airlifted to the hospital with severe head, brainstem, back, and pelvic injuries, which she died from five days later.
Damages: Wright’s children sought damages for loss of society as well as Wright’s pain and suffering.
Result: The parties reached a settlement for $2.4 million.
Employee v. Employer Confidential Settlement – Wrongful Termination/Sexual Harassment
Employee was sexually harassed by her managers, subjected to unwanted groping, touching and teasing. After Plaintiff reported the harassment, manager retaliated by humiliating her in front of coworkers. The company denied the claims, so the Law Offices of Jason A. Injured Environmental Engineer – Automobile Accident Personal Injury
For years this environmental engineer worked in the field, developing alternative fuel strategies in developing countries. An automobile accident in 2005 ended his career in the field. Not surprisingly, the insurance company would not pay the fair value of the case. After extensive discovery, and two mediation conferences, the insurance company settled for $550,000.00.
Independent Producer vs. Defaulting Finance Company – Entertainment Litigation
This client is an Independent Film producer who carried this Horror genre film project on his back to completion. The original finance company failed to provide promised completion money, but tied up the release in litigation. Following discovery and litigation, the matter settled at a mediation conference giving Producer his credit and priority in revenue, with the breaching company agreeing to take a reduced and lower priority payout.

At trial, the Law Offices of Jason A. Pollack represented both the producer and the father. We brought a motion for nonsuit to dismiss the claim against the father. That claim was dismissed with no payment by Father. The 3 Week Jury Trial that proceeded with the son as the sole defendant resulted in a favorable verdict for the client.
Uninsured Motorist Full Policy Payment – Automobile Accident/Personal Injury
This client suffered a devastating aggravation of a prior back injury in a rear end automobile accident. The driver of the other vehicle was uninsured. Following negotiations with the client’s own carrier, a settlement was reached for $400,000.00.
Tenant v. Landlord Warranty of Habitability
Landlord did not maintain his rental unit, and ignored Plaintiff’s requests for repair. When Tenants reported the issue the Los Angeles Housing Department, Landlord tried to evict Tenant. The interior door to this client’s cabin would not stay shut because of the cruise company’s failure to repair a faulty latch. After this client’s finger was caught in the slamming door, nearly severing it, client retained an attorney who failed to timely file her claim due to complex maritime law. Client sued attorney on a legal malpractice claim. The Defendant refused to make a reasonable settlement offer until shortly before trial. The case then settled for $300,000.00.
Injured Construction Worker v. General Contractor – Industrial Accident
The General Contractor left a large hole in the middle of the hallway after removing a vent. It then put a tarp over it so no one could see it. The Law Offices of Jason A.
